What EAR99 Actually Means

EAR99 is a classification designation for items that are subject to the Export Administration Regulations but are not specifically described under any ECCN on the Commerce Control List. It is not an ECCN code — it is a residual category indicating that no CCL entry applies.

EAR99 items include most consumer goods, common commercial products, and everyday business equipment that lacks the technical characteristics warranting specific export controls. However, EAR99 does not mean 'no restrictions apply.'

EAR99 Does Not Mean License-Free

A common and dangerous misconception is that EAR99 items can be exported anywhere without concern. This is incorrect. EAR99 items are still subject to General Prohibitions 4 through 10 under Part 736 of the EAR. These prohibitions address restricted end-users, end-uses, and certain sanctioned destinations.

For example, exporting an EAR99 item to an entity on the Entity List may require a license. Exports to embargoed countries like North Korea, Cuba, or Syria may also require licenses even for EAR99 items. End-use restrictions for weapons of mass destruction activities apply regardless of classification.

When EAR99 Classification Is Wrong

Items with data-confidentiality encryption can never be EAR99 — they must be classified under Category 5 Part 2. Items specifically designed for military applications may be subject to ITAR, not EAR at all. Items meeting technical thresholds on any ECCN entry must be classified under that ECCN, not EAR99.

Properly classifying an item as EAR99 requires positive evidence that all applicable ECCN entries have been evaluated and eliminated. It is never appropriate to assign EAR99 by default or due to uncertainty.
